Tax benefits
Employee meals — ₽0 in contributions when properly documented
In Russia, a pay raise is subject to social insurance contributions. A meal allowance set up as a social benefit is not: Russia’s Supreme Court has confirmed this position more than once. Here is a plain-language explanation.
In a nutshell
An allowance is not salary
Social insurance contributions apply to remuneration for labor: base salary, bonuses, pay supplements — everything that depends on position and results. A meal allowance is not tied to work: it is the same for everyone and does not reward performance metrics. Courts — including the Supreme Court — recognize such payments as social and do not subject them to contributions.

₽100 → ₽100
Company costs for every ₽100 the employee receives. The general contribution rate is 30%; for certain preferential industries it is lower. The exact calculation is in the calculator.
What to comply with
Three conditions from court practice
Courts recognize meals as a social payment when three conditions are met. All three are a matter of proper documentation.
Set out in documents
A collective agreement, a separate policy or an order. The employment contract contains only a reference — and not in the section on remuneration.
Equal for everyone
The same limit for all employees — regardless of position, base salary and work results.
Social in nature
Meals are a matter of care, not a bonus: they are provided on the days the employee works, and lunch cannot be taken away for disciplinary violations.
A product built for these rules
Plushki is designed around these conditions
The program was designed from the start so that allowances remain a social benefit and do not turn into salary.
- Equal limits for all employees are set up in a couple of clicks — this helps you meet the “equal for everyone” condition.
- Payments go through only at cafés and stores in the categories you choose, and the limit can be restricted to working days.
- In reports for accounting, allowances appear separately from salary — nothing gets mixed up.
- Reference templates (in Russian) of the order, the policy and the employment contract wording — download them and adapt them to your company with your lawyer or accountant.

FAQ
Answers to the questions we’re asked most often
Is this legal?
Court practice, including that of the Supreme Court, consistently sides with companies. Under Article 420 of the Russian Tax Code, social insurance contributions apply to payments made within an employment relationship, but the courts have clarified that payments which do not depend on qualifications or on the complexity and results of work are not remuneration for labor and are not subject to contributions. This is exactly how the Supreme Court assessed meal allowances (ruling of 4 September 2017 No. 303-KG17-6952 and a number of later decisions) — and courts still apply this approach.
How much does the company save?
For every ₽100 of a pay raise, the company additionally pays social insurance contributions — ₽30 at the general rate (since 2026, reduced rates have remained only for certain preferential industries). For every ₽100 of a meal allowance, when properly documented, contributions are ₽0. Plus, the allowance is not included in the calculation of average earnings, so it does not increase vacation pay. The calculator will show the exact figure for your headcount.
What needs to be documented?
The main thing is to set out meals in your company’s documents. A separate “meal payment policy” or an order by the director is usually enough; if the company has a collective agreement, it is even better to set out meals in it. The employment contract needs only a short reference to that document — and not in the section on remuneration, but among the other terms. The key rule: “salary” and “meals” must not be mixed in the documents. Reference templates of the order, the policy and the employment contract wording are collected on the “Document templates” page.
Is it true that the allowance must be the same for everyone?
Yes, this is one of the key conditions. Meals are provided to all employees in the same amount — regardless of position, base salary and results. If a senior manager has a higher limit than a specialist, the tax authority may treat the allowance as part of remuneration — and charge additional contributions.
Is there a cap on the allowance amount?
The law sets no fixed ceiling — the company chooses the amount itself; usually it is roughly the cost of a lunch. The main rule stays the same: equal for everyone. An allowance comparable to a salary will raise questions from inspectors.
We’re on the simplified tax system (USN) — does this work for us too?
Yes. All employers pay social insurance contributions regardless of their tax regime — the general regime (OSNO), the simplified system (USN), individual entrepreneurs with employees — so the savings on contributions are the same. Whether the allowance can be recognized as an expense, however, depends on your tax system — check this with your accountant.
What about personal income tax (NDFL) — is that not paid either?
As a rule, it is paid: payment for meals is the employee’s income, and personal income tax is withheld from it (what matters is that it is not reported as remuneration for labor). The savings compared with a pay raise come primarily from social insurance contributions. Agree on the accounting treatment with your accountant.
What are the risks and how do you avoid them?
Questions from inspectors cannot be ruled out entirely: the position of the Ministry of Finance in its letters differs from that of the courts, and companies sometimes defend their right not to pay contributions in court — when the paperwork is done properly, courts consistently side with them. The risk of losing such a dispute arises if, according to the documents, meals look like an incentive: different limits by position, taking away lunch for disciplinary violations, a clause in the “Remuneration” section, inclusion in average earnings. Keep meals separate from salary, give them to everyone equally and on the days the employee actually works.
Do we need to get anything approved by the tax authority?
No special permits are required — you need properly drawn-up internal documents and careful record-keeping. If inspectors have questions, the company relies on its internal policy (local regulation) and court practice, so the quality of the paperwork is what matters most.
